You has a right to cut the tree branches without asking or informing to that tree owner from your property, This issue comes under a continuing nuisance so no need to wait for your neighbour permission just remove the tree branches from your property without entering your neighbour's property for more details contact me.

You have got all rights to cut the branch that is trespassing your premises. You can file Civil case and also Criminal Case as well. The amount you give to the labour to cut the branch will be reimbursed by your neighbor in the Court of law. Yes, he has to pay you legally. You can trouble him anyway you want. Criminal case Or Civil or even Both. You have nothing to loose. You decide which one to opt and how tough or loose you want to go with him.
