Single case, filed under CrPC and IPC, but different dates?
19-Mar-2024 (In Criminal Law)
We filed a criminal case. Case under IPC sections were registered on date X while that under CrPC were registered on date Y.
Why is it so, when the case is only ONE?
And now, what will happen? as their next hearings are on different dates for both IPC and CrPC.
What if we want to withdraw this case as we are planning to change our lawyer? Do we need to wait for the longest hearing date among these two?
Your kind advice will be highly appreciated
The case is always registered on the basis of crime committed that is mentioned in the Indian Penal Code. And if you wish to withdraw your case then you need not wait for your date of hearing. You can always move a preponement application before the concerned magistrate and withdraw your case.
