18-Aug-2025 (In Criminal Law)
Hi, One lady put allegation on my friend that he stares her chest while crossing her in lift or lobby . My friend condemned her alligators and asked her to show any artifacts as we have cctv camera everywhere . She refused to give any proofs and not even told the date and time when she felt this . Can police arrest to my friend on her complaint. ? Should we go for anticipatory bail ?

Hi there, answer to both of your question depends on the stage of investigation. 1. If police has started investigation then what's the status of it ? (IO can answer that) 2. If police is preparing to register FIR or not ? (for it consult an advocate) Major facts in your case is if police is inclined towards registration of FIR or not for which you can ask IO directly but it's advisable to contact an advocate as they know the tactics of police. Secondly, Anticipatory Bail is applied after the FIR has been registered there's no use of applying it before as there will be high chances of rejection. It's advisable to contact an Advocate and prepare future strategies for the same.

Without any doubt your friend should move to the court for anticipatory bail as police at times in such cases even after knowing the reality sees it as an opportunity to extort money from the opposite side. Anticipatory bail saves you from such harassment. However if you want to discuss and understand the implications and solutions you can connect with us anytime.

Hello. Staring per se is not an offence under BNS. However if you apprehend your arrest then you can certainly apply for anticipatory bail whether or not complaint is actually made or not. You need to be vigilant and as and when the conditions are such that you know about the contents of the complaint or apprehend arrest, you need to contact the advocate. In addition I would advise you to go for quashing of FIR and stay of investigation in case a FIR gets registered in this fashion where there is no evidence against you and the complaint is false and fabricated.
