Seller is Unwilling to transfer the ownership of vehicle

23-Jul-2023 (In Criminal Law)
Recently, I bought a two-wheeler from a seller on OLX who is based in Delhi. After purchasing it, I found out that the vehicle still had a loan on it. Initially, the seller claimed to have bought the vehicle in cash and that there was no liability on it. Consequently, I paid the full amount to purchase the vehicle. When I confronted the seller about this issue, he made excuses and neither provided me with the Bank NOC nor transferred the ownership to my name. What legal action should I take?

It's advisable for you to first of all rather than going legally you should serve them a legal notice and in that notice you can write either stop all these harassment or face legal action which will be at your own risk. After that if they fail to give you a satisfactory reply then you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. For more legal assistance I am just a call away.

you are required to file for a case where in you are required to provide the payment done. Also this is a blanket forgery done by the seller and hence the sections relevant to forgery can be pressed against the seller. kindly get in touch to have a better understanding of the case

Sir You can proceed by sending legal notice initially and post that even if the issue is not resolved we can file a police complaint with respect to the same. Also the legal notice is required to be sent to the bank for intimation that you are initiating a legal action against the said person Regards Sanchit Goyal Advocate

File a criminal complaint of cheating and fraud. Also (if the elaborated facts deems fit in the case as per law) file a consumer complaint against the seller as well as OLX. you need to be vigilant while doing both.
