Seeking advise on threat call after breaking marriage prospects
11-Apr-2025 (In Criminal Law)
In May last year I got engaged at home. After a work trip to South Korea, the marriage was canceled and I was wrongly accused of aggression despite my efforts to resolve the issue. I repeatedly tried to contact them, even waiting outside their home. Later, my father received a lethal threat from someone claiming to be a local MLA. While I respected her decision, the threat is unacceptable. I seek guidance on filing a complaint for harassment, breach of trust, and trauma.
The circumstances under which the marriage got cancelled is unclear here in your query and needs to be specified. Cancellation of marriage at the most may result into civil action but giving threats is totally illegal. Yes you have legal remedies against the conduct of threat and harassment.
Based on the facts shared, you have valid grounds to seek legal recourse. You should immediately approach the local police station and file a written complaint detailing the false allegations made against you, the mental harassment suffered, and most importantly, the criminal intimidation faced by your father due to a threat from an individual claiming to be a local MLA. This act attracts provisions under Section 506 of the Indian Penal Code (IPC) for criminal intimidation, and you may also explore provisions under Sections 499 and 500 IPC for defamation if the false accusations have tarnished your reputation. Additionally, a complaint can be lodged for mental harassment and breach of trust, especially if there were assurances or promises related to the engagement which were not honoured without valid justification. It is advisable to consult a lawyer who can assist in drafting a strong and detailed complaint, and if the police are reluctant to register an FIR, you may also approach the Magistrate under Section 156(3) CrPC to seek directions for investigation.
