Jamanat milne ke bohat acche chance hai principle of parity ke andar, aapko bilkul bail ke liye prayas karna hai, lekin uske phele ye dekhna zarori hai ki zisko bail mil chuki hai uske virudh kya ilzam lage the aur kya saksh aur gawahiya aai hai, itna sab dekhne ke Baad kuch pukhta tarike se aapko bata sakte hai

कैस की फाइल देखने के बाद कुछ कहना ठीक रहेगा क्योंकि केस में आरोपी के ऊपर क्या चार्ज लगाए गए हैं इसपर भी बहुत कुछ डिपेंड करता है क्योंकि हर व्यक्ति पर अलग-अलग चार्ज लगा होगा भले केस 302 का है ऐसा लग रहा है मुझे लेकिन फाइल देखने के बाद ही कुछ कहना ठीक होगा लेकिन जमानत तो मिलनी चाहिए जहां तक मुझे प्रतीत हो रहा है

High Court har accused ka role, evidence aur circumstances alag-alag dekhkar faisla karti hai. Bail decide karte waqt court yeh factors consider karti hai: 1. Accused ka role – Kisne incident me kya kaam kiya (main accused ya secondary role). 2. Evidence – Uske khilaf direct evidence hai ya sirf suspicion. 3. Criminal history – Pehle koi case hai ya nahi. 4. Investigation status – Charge sheet file ho chuki hai ya nahi. 5. Parities ka conduct – Witness ko threaten karne ka risk, abscond hone ka risk. Agar dono accused ka role, evidence aur circumstances same hain, to dusre vyakti ko bhi bail milne ke chances zyada hote hain Sath hi court ka behaviour change ho jata hai kabhi ek ki bail ho gaye ho toh court dushre ko bhi bail ka benefit deti hai

Agar ek hi case me kisi ek vyakti ko High Court se Section 302 IPC me bail mil chuki hai, toh dusre vyakti ke liye bail lene ke chances kaafi badh jate hain, lekin yeh automatic nahin hota. Court har accused ka role, circumstances aur evidence alag se dekhkar bail decide karta hai. Main points jo dusre vyakti ki bail me madad kar sakte hain: 1. Parity ka Principle (Rule of Parity) Criminal jurisprudence me ek principle hai: “Similarly situated accused should be treated similarly.” Agar dusre accused ka role, evidence, circumstances pehle wale jaisa hai, toh court parity ke basis par bail de sakta hai. 2. Role & Allegations ka Comparison Court dekhegi ki dono ka role ek jaisa hai ya nahin. Agar dusre vyakti par zyada serious allegation nahin hai (jaise direct assault, weapon use), toh bail milne ke chances zyada hain. 3. Delay in Trial Agar case purana hai aur trial me der ho rahi hai, toh yeh bhi ek ground hota hai. 4. Custody Period Accused ne kitna samay jail me bitaya hai, agar kaafi lamba hai toh bail consider hoti hai. 5. Medical Grounds / Family Conditions Kabhi-kabhi personal hardship bhi court consider karti hai. --- Important: Bail application me clearly mention karna hoga ki co-accused ko same offence me bail mil chuki hai, aur applicant ka role usse bhinn ya kam serious hai. High Court ka purana order (co-accused ki bail ka) copy attach karni hogi.
