Regarding fruad sc/st act threatening
13-Mar-2023 (In Criminal Law)
There is an person who worked for me on my house making. We were giving him payment time to time. It was an contract. Mist of the amount from Total amount for making house was already given to him. Then we realised that his work was very poor and he is not working accourding to contract. Now he is asking for full money accourding to contract and threating to imply sc/st act if we did not do that.
We need your advice regarding this as we are in tense condition.
dear you must have contract with your contractor and their must be some clause of termination of contract between both the parties and if you were not satisfied you can terminate the contract . though you have not done any wrong by the way the only threat is he can file false case under st / sc act this is a matter of concern
The dispute between you and that person is in fact of contractual nature. The same can be settled by civil forums like Civil Courts, Arbitration or by a neutral Mediator. Since no person can ever threat a person for false implication in SC/ST Act, you have a right to register a Non-Cognizable Report(NCR) at the concerned police station U/S 504 IPC against that person informing all the facts so that he may be restrained by the police authorities. This may be a good defence for you against your concern of false implication.
