Recently i got scammed from one of my customer and he did a fraud.

I got scammed by my customer ge took my car on rent and mortgage yo someone now I don't know where is my car police is not filling case ad not taking any action.

you should file an application to register FiR before the magistrate for directions to police register FIR, once the magistrate direct police to register FIR , the case will be lodged. the process is very simple to file the application

If police is not taking any action then you have to file an application under 156(3) before concerned Magistrate. It would save you if your car get involved in any accident and also you can recover it by filing case of cheating and criminal misappropriation of property

Kindly file a complaint before the magistrate if the police are not providing you appropriate relief. As you said the ownership of the car belongs to then how can anyone mortgage your car. You need to give all facts of your case for a better suggestion to you.

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either return my car or money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a complaint in the court under section 156(3) for registration of FIR against the culprits. File a civil suit for recovery of the vehicle and also seek damages against the opposite party. In the alternative, if police are not taking any action move to the magistrate and file a criminal case seeking registration of FIR and impounding of vehicle under section 156(3) r/w 200 crpc
