Quashing A IPC 306 case In mutual Settlement

22-Dec-2025 (In Criminal Law)
Need some legal advice from people who have experience. In 2021, my sister filed an FIR under IPC 306 against me and my mother after my father’s suicide. The chargesheet was filed in 2022 and the trial also started in 2022, but till today (2025) no witness has appeared. Now both sides are willing for mutual settlement. If we file a quashing petition in the High Court based on this mutual settlement, how much time does it generally take for the case to be quashed?

If the petition is properly drafted and uncontested: Filing & listing: ⏱️ 1–3 weeks Notice to State + complainant appearance: ⏱️ 2–6 weeks (Often the complainant appears voluntarily and supports quashing) Final hearing & order: ⏱️ Same day or within 1–2 hearings

for this you don't need a HIGH COURT CALCUTTA ORDER...if we take up your case ...in hardly two months the case will be settled...yes there are provisions which lower court advocates don't know....and they might send you to high court but my advice is don't fall in that trap...and contact us asap.... Please do not go for quashing of case under section 306 IPC. Some things can’t be quashed by mutual settlement. Things like 306 IPC are like this. Please don’t waste your money. Instead expedite hearing from high court and get acquitted at the earliest. We can help you do it. Please call for more details.

Time period depends on the working of the Court. Firstly a settlement petition is made and before the Commissioner of High Court it is affirmed. Secondly it will be filed before the respective court with such determination. Then Advocate will move the case and inform the court about the same. Then High court with decide whether to quash it or not.
