Protest Petition Filing in MM court

Hello My query is that the police has filed a "C SUMMARY REPORT" in March 2024 and they got the hearing date of Jan 2025. I would like to know can I file the PROTEST PETITION in July 2024 itself by requesting the judge to take the protest petition on taken on board ? Kindly guide me

Yes, you may file the protest petition before the concerned Magistrate where the C Summary Report has been filed by police. If your protest petition is accepted then the Magistrate may either directly take cognizance under section 190 CrPpc, OR the Magistrate may direct the police to do further investigation u/s. 173(8) of CRPC.

Yes, you can file a Protest Petition by Preponding the Date of the Case. For this, you need to file an Application. In High Court, you need to file a Precipe to circulate your case file either on the same date or on a specific day in the next coming of days.
