Procedure of bail if application dismissed by MM

1. my friend bail application is dismissed by mm u/s 408/414/174A/34 IPC 2. after filing 2nd bail application that also dismissed by mm 3 than in which section of crpc bail application will be moved in session court.

Hi....plz provide me full information what do you mean by mm....if a bail is anticipatory it do have separate procedure and if it is regular bail application it having separate procedure...if u really want bail for your friend procedure doesn't matter but depends upon the facts how your advocate has moderate them.

The procedure to for bail under the Criminal Procedure Code is under section 439 where the court of session and the high court has the power to grant regular bail. A second bail application can only be filed before the same court where there are any change in the circumstances.

You may attempt to file bail application under Section 439 Cr.P.C. before he Court of Ld. Sessions Judge where you may get relief. It is necessary to ask whether charge sheet is filed or he same is still awaited

If two bails are dismissed then it entirely depends on the contents of FIR what FIR stands for??Therefore a reading and bare perusal of FIR will clear the concept and what bail should be applied ;off course it has to be a regular bail if he is not in police remand.
