Procedure for Cancellation of bail

21-Feb-2023 (In Criminal Law)
My in laws are accused in a case of 498A, 304B and 201 IPC.The case is of the year 1999. In addition there are at least 10 other legal cases under process in which my father in law is accused. They are of 420,307,etc. They are on bail under the 1999 case and other cases. Recently another dowry harassment and DV case has been registered against them. Can their bail be cancelled? If yes then please explain the procedure. They belong to Hindu religion.

yes their bail can be cancelled if it is proved that they are misusing their freedom and disturbing the evidences or can damage or can be a danger for any witness or if court satisfies that they can anyways effect the natural course of justice then yes their bail can be cancelled.

you have stated in your query that there are various cases against your father in law. what are those cases? who has filed the fresh dowry and domestic violence cases against your in laws? From where did they get the bail in the earlier case mentioned by you (High Court or the District Court)

Dear Client,

If the FIR is filed for a new case of crime, then your in-laws need to seek bail separately in the newly registered FIR, bail cancellation shall only be moved when at clear evident evidence will be produced that they have misused their bail.

on the abovementioned query if the accused's are on bail in the recent cases then please file immediately a plaint for cancellation of bail in the honourable high court with the certified copy of 1999 case's file order, FIR, change sheet etc.
