Dear Sir, It is not like that. Always police treat such referred cases as second preference case. The complainant must be in good books with police by producing evidence etc. Even 2 years time will be take to file report by the police. At last you can stop further investigation under Section 210 of Cr.P.C and request the Magistrate to go ahead by himself.

The delay caused in investigation will not matter much, but the evidence and statements. collected by the investigating officer and the chargesheet filed or final report filed after investigation will decide whether the complainant case is strong or the accused case is strong on looking to the chargesheet or final report filed by police in court.
