Please guide me on Counter Case filing and quashing of FIR

15-Oct-2023 (In Criminal Law)
I recently approached a supreme court lawyer regarding cross case filing and quashing of fir and that whether what should i do first in case one has efffect on another and amongst many things he said one sentence that i am unable to understand. Please explain what it may mean according to you. "In fact it would be a big thing if the court is taking the case in counter on its file. " Does he meant that court wont accept the counter case or did he meant that court wont take the counter case in consideration when i go for quashing of FIR or something else.

In very particularly you cannot file any counter case in the quashing case. Unless court grant you the permission on the basis only when you are the party before lower court. It is a case of the accused, you may file a application for intervention

Hi, my name is Gurmeet Singh, Advocate. cross case filing and quashing of FIR are different things. you can prefer both your remedies as available in the law. both can run simultaniously as there is no bar from filing either of them
