Person not returning money how to recover it

02-Sep-2023 (In Criminal Law)
I gave around 79K to a person who worked for a real estate company for getting my property from a company who had taken over property rights from the previous promoter. The person took Rs 79000 from us to as a cost to pay to MDC so that we can get a plot with MDC. I had made an online transfer to his account on 14th Jan 2015. His account is in AXIS Bank Savings accounts. He earlier agreed to return back the money but later stopped taking our calls. How to recover money?

First lodge an FIR against the person on grounds of cheating and then approach consumer forum court , you can get your money+ interests+ compensation + litigation cost. Consumer forum is very effective.

You have to send an Advocate Notice through your Lawyer for the reminder and also to recover the said money at a reasonable time but if he fails then you have to file a money recovery suit or any complaint case before the Magistrate court of your Jurisdiction.

first of all you have to serve upon the person a demand notice through an advocate seeking refund of your money with interest and give him a time of 2 weeks for doing so failing which you may seek legal redress in the appropriate forum of law through the advocate of your choice by filing a case against him under CRPC.

So, the person has cheated you. Do you have any document or agreement in between u and that person as to why u payed such big amount to that very person. you have the option of filing a criminal case of cheating against him either with the local p.s. where the transaction had taken place and if p.s. do not show any interest, file case through the court . Hurry consult a lawyer nearby.
