PC Act, what is the procedure to get my case present status report.

Hi good morning,nPlease help, what is the procedure to get my case present status report from an investigators Police officer(IO ) whereas it’s been 7moths completed but police had been not registering even Court had directed them to register the case in PC Act.. but here the police are deliberately lingering to process the Court Order.

You can file the petition u/s 482 CrPC in the High Court asking about the status report then police have to file it within stipulated time. Even in district court it’s just a matter of arguments and you must represent this unnecessary delay in the status report before the court. Court will then direct the concerned SHO of the police station to bring the status report. For more legal assistance I am just a call away.

you can file an application under section 156(3) Crpc to get the status report in the present complaint. The magistrate may ask the police to file a status report. As per your query the court had directed to lodge the case under PC act therefore the court is well within its power to direct filling of a status report.

hello client as i can see your issue is very much deligate as it is a matter of PC act case the pricedure is very much through courts only but id IO is not willing comply courts ordees then we have yo take little harder steps agaiant police .

To get present status report from I/O file an RTI.
Police has to compulsorily register an FIR after receiving directions from the Court.
If reply to rti does not disclose registration of FIR, file a contempt petition in the court of majistrate.
in the alternative you can also file a writ petition of mandamus in the concerned High Court of your state.

ask for action taken report from the police ... for the same you need to file appropriate application in the court of law ....you may also try to approach higher courts in Writ jurisdiction for the same
