Online fraud done by customer please help

We are online seller of electronics item on amazon marketplace. One of our customer has done fraud with us of amount Rs 352995. He has neither returned the product back and have received refund also. After contacting him several times he is not picking our call nor any response from his end. So can we file and FIR under section 420 against the said customer.

dear client as per your query since you are online seller of electronics items in Amazon and you faced fraud with you you must be having contact details and address you can consult me online by paying online consultancy fees ....

First of all you send a Notice to Amazon regarding this matter and make them party in this case . Don't make it online fraud , register this as a normal fraud case and register fir under section 420, 421, 467, 468 , because if you do only 420 then they can get bail easily but under 467 its come under Cognizable offense, so you get more scope to create pressure. usually the police in such cases won't register FIR. you may take the help of 156(3) or 200 as the case may be. but mind you this criminal case even if allowed would be susceptible to quashing if so approached by the accused. instead try alternative remedy. for details kindly contact any district court lawyer. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi University), Advocate, Hon'ble High Court, Calcutta
