Hi . I am Advocate Arka Banerjee , practicing and handling cases independently with a result oriented approach, both professionally and ethically . Started carrier in legal field, after gaining hands on experience in the matters of Section 138 of the Negotiable Instrument Act, and Arbitration matters.
Thereafter proceeded to enter practice in Calcutta High Court. During my tenure gained experience in Civil, Criminal matters in the High Court at Calcutta, Metropolitan and Session Court. Company, Arbitration matters in the High Court at Calcutta along with the appearances ,drafting and/or coordination in various district courts of West Bengal, Both Civil and criminal in nature, as well as in DRT & DRAT Company law Board.

Have obtained my 3 years LL.B degree from the University of North Orissa and LL.M in Criminal Law from Sunrise University.

Q: My documents problem 10th and 12th

I got problem in my 10th and 12th marksheet/admit got date of birthday and father name issue but my adhar and passport is right .. what i have to do

You need to file application before the Magistrate. With that affidavit you need to apply before the board authorities of class 10th and 12th for correction of same along with other evidence. This process is quite time consuming but it's a very easy process



Q: Divorce is valid and Can I remarry through registy

I had social marriage on 24th January 2020 and wrongly registered pre-marriage on July 2021 with same woman. Divorced on 12.03.23. There is no mention of that registry in the divorce papers. The question is whether my divorce is correct? The marriage registry officer says there will be a problem with the portal and you will not be able to register. Is the registrar talking right?

Divorce is correct, but think is that some how your registration of marriage not marked in your decree for that you can file petition before the CJM in that respective court. You need to wait 90 days from the date of decree of Divorce for further marriage registration as per Supreme Court.

Constructed a building without leaving side space during status que order by ADJ 4 th court and also and file one new case in junior division 1 St court by supracing the material fact.

Regarding this you can file Writ petition before the High Court. so you get immediate attention regarding this matter. and if order comes in your favor then you problem will resolved. After order from High Court opposite party don't get any options except appeal in Supreme Court, which is very costly



Q: Withdrawn of 498A and i} risk of DEFAMATION ii) pending DIVORCE(13B)

My friend's Sister filled 498A against her husband for heavy mental cruelty and minor physical torture. They didn't have any husband wife relationship but not she sure that husband is physically impotent or not. (may be mentally) Now for getting Mutual Divorce. Husband ask her to withdraw 498A.If she withdraw 498A i) can husband filled DEFAMATION against wife in later?ii) After withdrawn of 498A if Husband not given final consent for mutual divorce, what to do? Can she restart the 498A?

For this instance both party can sign an MOU regarding the Mutual Divorce. and after getting divorce she can appeal for maintenance. maintenance is applicable after divorce. Q: Bank Account of a deceased jointly with spouse.

Spelling of Title in Bank Account is 'MATHULI' and in Death Certificate it is 'MATHULY' . Under this situation how his wife, joint holder under Either or Survivor Clause, can withdraw money from the said account. She is issueless, about 69 years old, residing in a rented room, very feeble and no one to look after.I am his nephew, residing far from her house.
