Not getting my money back from Delhi based company

I had started a business with a Platinum plaster India ltd ,Delhi based company and when the business was over, there was an agreement, but after taking our money transactions, the company is not refunding my money back to me.I have been demanding my money from the company for a long time but I have not been able to get my money, please, please let me advise to file my case in consumer Court or in which civil or criminal case?

Do not worry, you need to get a legal notice sent through a lawyer seeking refund along with interest. In case they do not refund money inspite of legal notice, you need to file a civil case for recovery. You may contact for further discussion.

you need to get a legal notice served through a lawyer. Even then if the party refuses to refund money you need to get a civil suit for recovery filed seeking refund along with interest and damages if any. You may contact for further guidance.

You have various criminal and civil remedies available at your disposal. consumer complaint will depend upon the facts of the case and we'll have to prove that you were a consumer. as far as the agreement goes, it should be a civil case.

1. You cannot file a consumer case the money transaction is commerical, hence you are technically not a consumer.
2. If you file a criminal case, the chances of success are quite thin as it is very difficult to prove in court that the other party had some criminal intention.
3. The appropriate way is to either file a civil suit for recovery or a suit for specific performance, asking the other party to perform his part of the agreement.
Additionally, you may also first try to send the other party a legal notice of demand through an advocate, which may itself save you from all the court tussles.

Hi first of all when was the agreement been done and all what did they say and all how much was the Recovery and all what are they saying and all what was the business and all which year did it start and all we have to look at that and everything u can file a criminal case or Civil suit

if you could provide me with the entire details of your transactions, we can decide as to what nature of cases can be filed against the company.
generally the nature of transaction between you and the other party will decide the nature of case to be filed against them
