Need to Follow-up FIR?.........................

28-Aug-2023 (In Criminal Law)
Hi - I am an NRI. I went to India and lodged an FIR for forgery of loan documents and then came back to US. Do I need to keep following up with the police now on? Is there any stipulated time the investigation should be completed by? The police has asked the bank for original copies but the bank has not provided them yet. It's almost 35 days since the FIR was lodged. If the bank delays in giving the original documents to the police, what will happen?

Since you have filed the complaint and are not available in the country it is firstly advisable to get a power of attorney executed in some one else's name who resides locally. Further, loan agreement as sought by the police has to be given by the bank and you have no role to play until and until and unless police personnel contact you for the same. Since it has already been 35 days you should proceed under Section 156(3) before the magistrate as police being an interested party can be manipulated

If the police is not provided the copies or if the police itself is not taking any action on the complaint lodged by your goodself then you can approach the court for the records or for further investigation

Dear sir, Yes there is a stipulated time to complete the investigation. In this we need to check whether the investigating agency have asked the bank to supply the essential documents and further have to very that whether the police have issued any notice or not. We have to follow. For better consultation I need to check the status of your complaint, the fir and all. Suggest time for talk. Thanks

If you want to know the status of your F.I.R. or the action taken on your complaint, you can file an application to the concerned court regarding the status or the action taken by the police on you F.I.R. and also to know the current stage of investigation. If you want to get it done soon then, unfortunately, you need to follow up, police are generally overburdened with their piece of pies so they do not take pain to clear their pile.
