Need information and clarity on the Anticipatory Bail Order

05-Jul-2023 (In Criminal Law)
Hello! I need information and clarity on the Anticipatory Bail order. In the Order, it is mentioned as "all the Five accused shall be released on anticipatory bail on their furnishing one or more sureties of Rs.15,000/- each (Rupees Fifteen Thousand only) and PR Bond of like amount each till filing of final report by police". My questions are: What is the default time window given to furnish the surety, .i.e. Within 7 days Or 15 days? What if the surety needs to be converted to cash bail? If possible, what process needs to be followed for the same? How much amount do we need to pay for cash bail? What if we furnish the surety after the cash bail, then will we get refund of the cash bail total amount? If yes, then within how many days? What is the meaning of 'PR Bond of like amount each' here? Does the process need to be followed at the concerned Police station or the Court? What if we furnish single person as surety who earns monthly Rs. 80,000/-, so will that fulfill the surety?

The condition of anticipatory bail has to be fulfilled before the police station when the concerned investigation officer decides to arrest you. Surety has to be furnished along with PR bond before that officer who shall then record it and will release you.

Well, PR Bond is Personal Recognizance Bond. It is a Bail Bond by fulfilling which along with submitting affidavit of which, you give assurance to Court, that, you will appear on all future Dates in Court. When Court asks for One or more Sureties with PR Bond, the accused needs to produce Sureties of equal amount as stipulated in the Bail Order. All Suries need to fulfill Surety Bonds.
