Mobile phone theft case and getting accused for the same.

06-May-2023 (In Criminal Law)
Sir, i found a mobile phone on street and it was not having sim and any details, so identifying the owner was not possible for me. Then I started using the same mobile with my sim card, and after 3 months I got a call from local police station that the phone is stolen and fir is lodged against it. I told the cops that i found it on street but they said that it is found in my possession so i am the accused for theft. I dont know what to do next please help, i have not seen the fir copy till now. What step should I take next.

Hello sir. I have read your query. No charges of theft can be brought against you as the truw owner of the phone was not in possession of the property at the time you found it. At the most you could be charged with misappropriation of property. Feel free to reach out to me in case you wish to discuss this further.

the police will go on facts and as per them, the phone was found with you after getting stolen. you will shortly be called to the police station and will have to give a statement and do other legal formalities
