Please file petition to declare the marriage as null and void and for cheating. also please get the details of previous marriage and details of divorce,if any.

You can very well approach the Family Court of your jurisdiction to declare the marriage as null & void on account of suppression of material facts. You can also approach Criminal Court accusing the lady of fraud committed on you.

Hi,

Need not to worry at all.She had committed a criminal offence that she have misrepresented the fact she was married and had a child. If she had not obtained divorce, the marriage with you void ab-initio. It is not a valid one and you have not at all married her.She is liable for Cheating you. There are two remedies in front of you (i) File a case for Defamation for monetary compensation (ii) Lodge a complaint to the S.H.O in the Police Station. (You can initiate both at the same time !!!)
And,please note that the problem you brought is a simple and a silly one.

There was a primary responsibility on your part to do a thorough detailed check on your prospective partner before entering into matrimonial relationship. Since there was neglect on your part for doing the same you are partly responsible for the same.
However, the lady appears to be a fraud who cheated on you by hiding the fact of her previous marriage and being a mother.

Please be specific on the fact whether your marriage is registered or not. Presuming the fact that both of you are majors.
If your marriage is registered immediately try to find out if your current wife is a divorcee. If not she is guilty of Bigamy. Legal Proceedings can be taken against her for Bigamy.
Marriage during the subsistence of a prevailing wedlock is void. Kindly, intimate the same to your parents and elders and and find a solution for the same.
