Q: Married a woman now came to she was married with a child
I married a lady who had convinced that she has no one without the consent of my parents. But,actually she was married to someone and she had a child too. Now she's blackmailing me. I'm mentally so disturbed. What can i do legally against this?
Advocate P Sreelaxmi answered
There was a primary responsibility on your part to do a thorough detailed check on your prospective partner before entering into matrimonial relationship. Since there was neglect on your part for doing the same you are partly responsible for the same. However, the lady appears to be a fraud who cheated on you by hiding the fact of her previous marriage and being a mother. Please be specific on the fact whether your marriage is registered or not. Presuming the fact that both of you are majors. If your marriage is registered immediately try to find out if your current wife is a divorcee. If not she is guilty of Bigamy. Legal Proceedings can be taken against her for Bigamy.Marriage during the subsistence of a prevailing wedlock is void. Kindly, intimate the same to your parents and elders and and find a solution for the same.
Q: Procedure to change caste from scheduled to forward category
I belongs to scheduled caste category. My parents has a inter-caste marriage. Father belongs to scheduled caste and mother from forward caste. I would like to change my caste from scheduled caste to forward community same as mother. Pls advise me about the procedure for changing g the caste from scheduled caste to forward one
Advocate P Sreelaxmi answered
Dear Client, Caste is determined by birth. The caste of a child is determined on the basis of His/Her fathers caste and mother's caste is irrelevant. Hence since your father belongs to SC you too fall under SC as far as caste goes.
Q: Bail taken from court but lawyer not providing case no
Sir, there was several bank transactions to the tune of between May 2010 and Aug 2011 We returned 1.5 lack through bank and rest in cash. In September 2016 he filed an FIR under Crpc 156 (3).We got AB from sessions court and got regular bail from court. Thereafter there is no communication either from court or police station. Due to safety reasons we could not go and inquire in person. Every now and then advocate is asking money he says police filed charge sheet but not providing a copy or case no. . I enquired through on line ecour. got. In site there is no case even when I check daily board of the court on which the adv says the case date it doesn't show my name. Please help me
Advocate P Sreelaxmi answered
You have not specified as to the amount of loan/money taken by you and for the purpose taken. Though you have mentioned that you repaid an amount of 1.5 Lakhs and rest through cash, you have not specified whether you got an acknowledgement for the same. If you have not obtained an acknowledgment it is as good as non payment of rest amount . Hence, please be specific on that aspect.Have you gone through the FIR and are you aware of the charges framed against you since you have mentioned that you got a Bail. You need not go in person your representative may be send. Be strict on asking your advocate the case number and try obtaining a copy of charge sheet. Specify to your advocate until and unless he/she provides you with the details you are not going to make any further payments. Keeping the client in dark in regard to the clients case is against professional ethics and amounts to professional misconduct.
