Liability in car accident case

Hello, yesterday i was driving on elevated road, n suddenly a maruti van came from wrong side and hit my car from front, he was injured n taken to hospital. now police have siezed my car aswell . even though i told them i dont want to file any complaint against him n i will get my car repaired on my own. but police is asking me to file FIR against him. now only problem is my car's insurance is expired. i need to know if there's any case against me? though i have video footage of accident site where its clearly visible that maruti van came from wrong side.

Apko FIR file kara deni chahiye because aage ke liye koi problem na h.. ho skta h injured person apke against koi case file kr de aur video footage apne paas hi rkhna proof ke liye jisse ki jb footage ki need ho to ap usko show kr sko.. and car insurence apka expired ho chuka h to claim to apko nhi mil payega
