Legal Notice for Alleged Flight Ticket - Potential Fraud

25-May-2024 (In Criminal Law)
I received a legal notice from a travel agent demanding payment for an alleged flight ticket that he said he issued for my brother and was non-refundable. Air India confirmed that the ticket with PNR that the agent provided us was automatically canceled. The agent is claiming full ticket costs, and I suspect this is a fraudulent attempt to extort money. My elderly parents are very stressed by this situation. How should I proceed to address this issue legally and protect my family?

Hi, If the travel agent didn’t book the ticket on your directions then he will have to prove first that he did specially on your directions. Only then he will be in a position to ask any kind of money. However if he proves that you directed him to book the ticket then you will have to take a proper defence otherwise you may be liable to pay him the money. You must brief the matter with all the facts of the case for me to give you proper consultation as to what could be the possible outcomes of the case.

firstly, send legal notices regarding cancellation of automatic flight tickets, if not expired 30 days. Then file a legal complaint after an expiry period of 30 days of sending said notice. But keep in mind, if they sent you a reply of said notice and appears are going to compromise, it is upon you to go for it or to proceed further. if you opted to proceed further, file a legal complaint before the Consumer Forum seeking damages. further, in the meantime you come across fraud committed by the agent, then also register a criminal complaint against him.

If it was cancelled and the AIR India has already confirmed it, then you need not worry. You have to answer that legal notice through an advocate and further you must file a complaint with the help of the advocate.
