Hi,
if you have proof for transferring the money in her account or money given by cheque than you can file a case against her i.e. suit for recovery or u/s 138 NI act through advocate. Further their is no any other provision available for cheating by girlfriend in Indian Law.

For her cheating crime, you should lodge an FIR with Police, so that she does not cheat anyone else.
However, this will not result in winning back her love. Also, please remember that criminal cases have to be fought till the end and involve several rounds of examination and cross-examination.

Do you have any written proof of giving that money. By what mode you have given her money ? via DD, NEFT, Cheque ?? You can file police compliant or Criminal Case or Case of recovery against her if there is something in written or you have any proof of it.

File a criminal case against that lady who has cheated you and took your fourty five thousand. Hire some lawyer and your complaint will be drafted by the lawyer and after that by filing in police station you will get your money back.
