In a land purchase transaction, there is a relationship between the buyer and the seller, and according to the law, the only condition in exchange for land is money. If this is not fulfilled, if the seller does not receive the money, it can be said that the transaction has gone wrong. The agency has no legal role, but there is a way out of this.

Act) File a Criminal Case (Cheque Bounce - Section 138 NI You can proceed if: Cheque was issued towards a legally enforceable debt or payment Cheque was presented within 3 months of date of cheque Bank returned cheque with memo (example: Funds insufficient, Payment stopped, etc.) You sent a legal notice within 30 days of cheque bounce memo After notice, if the person doesn't pay within 15 days, then you can file a 138 NI Act complaint in the court. ↓

Based on your facts, the sale deed was lawfully executed, registered and 7/12 was transferred in your name. After registration, the seller cannot unilaterally cancel the sale deed. His remedy, if any cheque was dishonoured, is only to proceed against the agency under Section 138 NI Act or for recovery of his balance amount. Since you paid the agency and not the seller directly, there is no fraud from your side.

Since the Sale Deed is registered and the 7/12 extract is in your name, the title has passed. Under the Transfer of Property Act, unpaid money doesn't void the sale. After 4 years, the claim is likely barred by limitation. You must reply to the notice through a lawyer like me, proving you paid the agency. A registered deed can only be canceled by a civil court, not the seller alone.
