Juvenile justice Act 2015/pocso act

30-Mar-2023 (In Criminal Law)
A juvenile who was 14/15 year old in 2004 when he/she unknowingly commited asexual assault(only touching in appropriate) on another kid. Now in 2020 they want the grown up juvenile to be apprehended for the same because that time they did not file the case. Now in this case which act of juvenile justice will be followed and what will be the punishment? Also is this going to stigmatize the then juvenile career now? Kindly advice

The date of offence will be considered for all purposes but it will be tried by regular court and provisions the then juvenile Act will be taken into consideration and the delay is question. Whether it can be registered ? now.

The complaint is belated and cannot be entertained by the police even if police register FIR the same will be quashed by the High Court if you approach.... Filing any complaints must be within a period specified belated complaints are not admitted

hi. you stay that there was an offence made out against u by the victim but fortunately the same was not registered nor any legal action was made against you. Hence don't worry about they find a case under posco. it is rather bared by limitation. As criminal jurisprudence state that the offence made out shoild be complained as early as possible. you stay that the incident happened long time ago. hence nothing to be worrried .eventhough if they file any complaint it becomes infactious. Rate us if u r convinced
