Dear client based on your query, exploring the possibility of seeking relief through higher judicial authorities or relevant administrative bodies could potentially address the clerical error in the property records, for relevance we can help you regard the process and in legal ways for which you can connect with us.
I understand your concerns regarding safety and the challenges of filing an FIR under the Prevention of Money Laundering Act (PMLA), especially given the influence of the accused parties.
While an FIR is typically required before submitting a complaint to the Enforcement Directorate (ED), there are alternative approaches:
Anonymous or Confidential Complaint: You can file a complaint directly with the ED under Section 66 of PMLA without disclosing your identity publicly. Whistleblower protection mechanisms may also be explored.
Approaching Higher Authorities: If local police are unwilling to register the FIR, you can escalate the matter to the Commissioner of Police, the Economic Offences Wing (EOW), or even the courts under Section 156(3) CrPC to seek directions for FIR registration.
Legal Protection Measures: You may file a writ petition before the High Court seeking protection and monitoring of the investigation to prevent any threats or coercion.
Media and NGO Support: In high-value cases, media exposure and legal advocacy groups can help ensure independent investigation while protecting the complainant.
Your safety is paramount. Legal safeguards exist to ensure that justice is served without endangering you.
