Is Chatting with a Call Girl a Crime? Need Legal Advice After Suspicious Call

04-Jul-2024 (In Criminal Law)
Hi, I recently got a number from a dating site and started chatting with a girl. Here's a snippet of our chat: Me: Hi She: Hi She: Paid Service Me: Real meet? She: 4K booking, 8K total for the night A month later, I received a call from +91 8481890852 claiming to be from the Haryana police station, stating that I had spoken with a call girl who was arrested in a raid. They asked if I wanted my name removed or if I would fight a legal battle with my lawyer. When I asked for details and said I needed to consult my lawyer, they pushed for an immediate answer. Later, they messaged me from a different number, +91 72788 94719, on WhatsApp, sharing a screenshot of our chat. The girl I messaged was +91 7797241588. Please advise if I should report this to Cybercrime or ignore it as a spam call. I'm confused about what to do since chatting with a call girl is a crime.

No, private chatting with an adult sex worker is not itself a criminal offence in India; criminal liability arises only when the conduct involves illegal acts such as brothel-keeping, public solicitation, pimping or trafficking (Immoral Traffic (Prevention) Act Sections 2, 3, 5). [https://indiankanoon.org/doc/86578091/] The Supreme Court has recognised the dignity and non'punishment of voluntary sex workers (Budhadev Karmaskar v. State of W.B.). [https://indiankanoon.org/doc/1302025/] But coercion, procuration or trafficking are serious crimes under the Bharatiya Nyaya Sanhita Section 143 (trafficking). [https://apnilaw.com/bare-act/bns/section-143-bns/] If you receive fake police/impersonation calls demanding money, that is extortion/cheating under the BNS (see Sections 308 and 318) and should be reported; preserve call logs, chat screenshots and transaction records as evidence. [https://righttolaw.com/bns-section-308/] [https://www.latestlaws.com/bare-acts/central-acts-rules/bns-section-318-cheating-] Report such scam calls immediately to the National Cyber Crime Reporting Portal (https://cybercrime.gov.in/) and local police (BNSS requires the public to give information of certain offences, Section 33). calling a call girl is not a crime. even chatting with a call girl is also not a crime till the chatting is within limit and girl donot object or oppose. The call may be a spam to blackmail you in order to extract the money. donot get trapped. Report the matter to police. The given numbers seem to be from Andhara Pradesh and Chennai. check on true caller.
