okay so 354 IPC offence is for stalking and if a person has committed stalking is that person is liable and it is a bailable offence okay so if a person is who has committed the offence is mentally non stable and is not having a good mental condition can get his or her FIR quashed and it does happen if we are taking that exception that the person is not mentally fit then the duty is upon us to prove it not like ki FIR quash Nahin ho sakti FIR quash ho sakti hai but usmein Hamen vah chij proof Karni hoti hai

yes fir can be quashed u/s 482 crpc by high court if proved that at the time of committing offence the accused was of unsound mind. you can always apply for bail and prove that in trail court and can file discharge application
