Inaction of Police and filing of case in the Court

31-May-2024 (In Criminal Law)
My friend and his younger brother were assaulted by a group of people. They reported the incident to the local police and got an Injury Report done at a Govt Hospital . Police provided a General Diary no . Despite providing names, the police haven't taken action or questioned them. It's been 3-4 months. If they go to court now, will the case be refused due to the delay?

The delay is not in your part it's in the part of the Investigating Authorities. The Magistrate can be approached for providing a direction to the Officer in Charge of the Local Police Station to lodge an FIR and so the needful. Delay will not be a factor. Regards

There has to be proof for delay in filing a case in Court. Looking at the brief you have a case which can get fruitful result from Court. Please ensure you move with an Advocate who has experience in dealing these kind of issues where Police is one of the opposite party.
