i was charged ipc 452 its is fake charges on me

i case against the neighbbour regarding civil matter .so she defend herslf from civil matter .so they charges ipc 452 on me and hurt herself the women age is 70 and she gave her medical without investigated my medical ,there is no evidence of that i hurt her physcially . i live in dda lig neighbour reside in first floor i live in ground i just used stairs for change the tank she then hurt her slf and harmed me and charge this fake case can i be charge for this fake case its happened in oct 2018 .still police has not prepared charge sheet file against me .othing is hasppened after that just they registred fir against me and my brother who is juvinile .

as i can read in ut query u are ur brother who sis juvenile has been charged with 452 ipc by an lady who is of 70 years old narating a self created story is the over all base if her story .you are saying tht you have not done anything . so there will be criminal action against ur borther and you immidiatelly you have to move to high court fir cancellation of FIR quite possible high court may cancell the FIR. otherwise uou need to fight the case. first yo need to take anticepatory bail urgently.

The question is not clear, need to better understand your case for better advise. You should first provide all material favouring you to the police so that your witnesses and material become part of chargesheet. You should also file quashing petition and anticipatory bail application.

this is a very common occurring where a person files FIR against a civil case. you can go in for quashing the FIR altogether or wait for the chargesheet and see the contents, if the offence can be proved or not and then take action.

Hi,
in this regard i would suggest you to first of all take anticipatory bail from Hon'ble Court and thereafter when the chargesheet is filed, you may contest the case on merits. Would like to see the contents of FIR.
