I need to know about some matters seriously fr my bro
13-Mar-2023 (In Criminal Law)
He is in prison fr ndps act fr nearly 7 months still did not recieve bail ..
1. Will there be any criminal record on his name after he gets bail
2. Will visa background check get to know his record and restrict him from immigrating abroad
3. How long will the case take to finish trials
4. Is life hard for him after this
it depends on the conditions imposed by the court while obtaining the bail , normally condition will be imposed for not leaving the country, even offences in FIR also counts, discuss with a lawyer regarding this, you will get a right advice on facts and circumstances of case.

Hi,
usually in ndps cases, the special court rejects the bail for accused, but you try once in high court for bail.
and after he gets bail, it doesn't mean that case is finished, you will have to contest the case, and it is either acquitted or convicted his name will appear in records as accused.
with regards to 2nd point, there are chances for that.
regarding 3rd point, it may takes years, but still it depends on advocates.
regarding 4th point if he is convicted his will be imprisoned, his life will be hard only.
so i suggest you to go a head with bail in high court, and after he gets bail, then after filing chargesheet then apply for discharge application before the special court.
