I have been cheated from my boyfriend of 3 years relationship .I have been married for 8 years but we were not so close as my husband were posted in lucknow. Meanwhile I met this guy and we both fall in love.We were in physical relationship,he promised to marry but now he refuses meanwhile he assault me ,taken a lot of money which he refuses to return back. And above that he raped me in 4th october and made a video and pics of that.my husband doesn't have any idea of this. Can he file against this guy under section 497. This guy is unmarried and I have got all the audio clips were he is accepted of raping me and taking money from me around 2 lacs.plz help me out

Dear client,

You can file complaint of rape in the police station against that person and show that vide clip to police officers. Dear client you can't file case under section 497 IPC against that guy. Dear client for more clarification u can contact me and I m happy to help u.

From examining all the facts of your query I want to say that-
I can understand your problem. There are some incidents that happen in your life and those incidents are so strong that they change your DNA. You must know that Supreme Court judgement has struck down Section 497 of the India Penal Code. Adultery can be ground for civil issues including dissolution of marriage but it cannot be a criminal offence.

You cannot file a case against that guy under section 497 but there are many other sections of the Indian Penal Code in which the case can be registered as you have got all the audio clips where he accepted raping you and taking money from you of around ₹2 Lacs.

First of all what is the enough evidence u have against this guy and all what did he say and all first we need to know the full matter then only we can proceed with the Matter and all what did the guy say and all u can file a complaint against him

A case also in the court against him

In this regard, I advice you to pursue your complaint at the nearest police station for rape and proceed with it. Furthermore you can also add section for extortion in the complaints it’s high time your should understand that you have to timely report the complaint and if you take more time then it will go as against you and in law then you be required to explain the delay in lodging such complaint.
