Husband jailed under ipc 306 for 5 years when will he get bail now

ajj mere husband ko ipc 306 mai judge ne 5sal ki sza sunayi hai plss app suggestion de skte ho hum ab kya kre or kine mnth baad bail mil skti hai???

Hello dear questioner, let me tell you in shortcut that first of all you will go for an appeal in high court,within the specified time limit and there you can apply for the application for bail. Dear queriest, 1) you can file bail application in superior court after completion of one third of the imprisonment term. 2) you have the right to move appeal or revision as the case may be in the superior court.

Generally the settled law by Supreme Court is when accused undergone 1/3 of sentence then he will be entitle to bail.....but if a case is weak or someother loophole in the case...then there is no such limitation for bail..may be accused get the bail in 2 months.it will depend on case to case
