Generally the settled law by Supreme Court is when accused undergone 1/3 of sentence then he will be entitle to bail.....but if a case is weak or someother loophole in the case...then there is no such limitation for bail..may be accused get the bail in 2 months.it will depend on case to case



Q: Procedure to recover amount from India if living outside India

Hi, I'm from Canada. I met someone online last August from India and and they used to sell me products for cheap prices, we did lots of business together. Starting around March this year they started offering me extremely good deals and I sent them over $15000 USD worth of money. They never delivered, then the person started telling me he needed a loan because he got in some trouble and once it's all dealt with he will refund me all my money, so I ended up giving some more money and now they owe me around $22,000 USD and they have been stalling for months. I have the persons Indian driver license and proof of who they are and lots of chat log evidence. He has also scammed lots of other people. My problem is I live in Canada, and this guy lives in India (a place called Patiala which is very north of India). How can I get my money back form this person, I need to hire a lawyer but I'm not sure how I can hire a person in India to take this case because I live in Canada.

U can issue power of attorney in favour of your freind or in favour of any relative...who can go to the court on your behalf and signed the documents which will needed to file a case...and further more when you have to filed case against him..first of all you filed an application before SSP to register a case of cheating against him
