Can i withdraw 498 on the basis that i am looking for mutual divorce and do not want to persue further

your question is you can withdraw 498 on the basis of mutual divorce and you do not want to pursue further action against them ... first of all i wamt to know that fom which place and when you case came

I have seen your query carefully and found that you want to widrawal of case of 498A IPC and 3/4 dowry prohibition act against your husband and his family on the basis of compromise to file a petition for divorce on mutual consent basis before the family court. in this situation it is very much important and necessary to settle down all the issues with your husband regarding the maintenance and alimony etc then file a petition for divorce on mutual consent basis. After filing the petition and at the moment of filing second motion of the mutual consent divorce you can file a application along with affidavit to widrawal of case of dowry demand etc. . yes that can definitely be done.. I would though like to know as to in want stage your litigation is... as only then appropriate remedy can be provided for withdrawal. It appears that an application under 482 is pending consideration ..We For a further detailed response you can come to our chamber.
