How to quash fake counter fir when police is not helping us

12-Mar-2023 (In Criminal Law)
Namaste, Me and my mother have some civil issues with our neighbour but one day 6th March they started physical assault and hit my mother. 6th night my mother was hospitalized and we got MLC from hospital. She had got a minor fracture on her rib. 7th my mom discharged and on 8th Me and my advocate went at 9 am and asked to file an FIR on the accused. That day afternoon police came for site visit, understood the situation and by evening filed an FIR with sections 143, 323, 324 , 327, 341, 354B, 504, 506, 149. Later we got to know that the accused has made his older mother ( who too is accused in our fir) file an FIR against me and mother with a fake complaint on the next day (9th). the sections they put are the same wnat we put. the fake complaint says that we went and hit them on 8th morning. but 8th morning we were at PS to file the FIR with my advocate. This clearly shows that they bribed the Police and therefore seems like we cannot expect any help from police. Please help me

If the FIR has been registered on a false pretext, you’ll have to have that quashed

It can be quashed under a 482 proceedings filed before a High Court.

first get bail from court and then after investigation if the police find their case is fake they will file a final report after investigation that their case is fake, further it is also likely that in both cases chargesheet can be filed and there after in court after taking all evidence and arguments court will decide about the two cases, the first thing to do now is get bail.
