How to obtain bail in a suicide case
31-May-2023 (In Criminal Law)
My father has been arrested on 22/5/18 for 306 ipc. Actually he lent money to a person and that person committed suicide on 18/5/18. His son lodged FIR alleging my father and 3 more people pressurised and intimidated deceased and out of that pressure deceased committed suicide. My father still is in jail. Plz suggest me further course of action... Bail is getting delayed since Monday .
Normally your father will be released on bail by sessions court don’t worry the matter will not last for long after the police investigation is complete and charge sheet is filed you prefer an application seeking Quashment of Charge Sheet before Hon’ble High Court through which the case would be quashed don’t worry
If the magistrate rejects bail application (which is generally done in such cases) file bail application under s. 439 CrPC before the court of session. If sessions court also refuses bail then file it under same section before the High Court. Generally High Court allows bail in abetment of suicide cases.
Please wait for submit charge sheet. After submitting charge sheet more chances to your father getting bail. For better advice Please provide some details that your father's co accused 3 other person are arrested or not.
My dear friend your father will get bail from the court very soon don't worry first you tell me does your father lent money to that person on interest? If yes then do he have a license to give money on interest? If your father give him money without interest so there is no crime done by your father. Second thing you have to wait for disposal of that application from the court if your father get bail that's will be fine otherwise you have to filed a bail application in high court of your state. But it will go to your favour that your father is in custody from one month so in my view your father will get bail from the lower Court.
