Section 380 of the IPC deals with Theft in Dwelling House....,Etc .You can mention the real status of your brother to the Court with the doctor's prescription while you go for bail. The court will consider the medical status of your brother.

Under such circumstances we can submit the relevant documents about his medication in the court along with surety to seek bail. The chance of getting bail in such case is high. So you can go ahead and file a bail petition along with the relevant documents.
