How One Can File Discharge Petition U/S 139 Crpc

I want to file discharge petition u/s 139 of crpc. It is the case of 498@, 323,504,506,3/4 against my elder brother (husband). I am younger brother. Currently my brother applied for mediation from highcourt so the high court ordered stay on proceedings. My ques is that can i apply for discharge petition at this time at lower court or i have to wait till the stay get ended? Also advice any other remedy by which my name can be quashed from fir.

wait till the sec 482 of crpc is finally disposed off or dismissed by the court if it is dismissed then you can proceed for discharge after the charges are framed by court against you or your brother first you have to file for your bail and always insist on medical report of his wife which proofs 498 A

Hello...
You can definitely file for discharge petition in the court....
Mediation proceeding is a different thing and different proceeding..
And you can go for Quashing of FIR from HIGH COURT...under Section 482 CRPC...
There are many more remedies available...
