In 498-A and allied matrimonial offences, the High Court exercises inherent powers under Section 482 CrPC to secure the ends of justice. Once the dispute is referred to mediation by the High Court and a settlement/MOU is arrived at, quashing is not confined only to those who initially filed the petition. If the husband participated in mediation with the knowledge of the Court and the crime number is specifically mentioned in the MOU, he is entitled to seek quashing on the same settlement. The wife’s subsequent objection by itself is not decisive. The Court will examine whether: The settlement was voluntary and without coercion, and The dispute is purely matrimonial/private in nature.

Since an MOU was signed in mediation and your parents' FIR is already quashed, the High Court is likely to quash yours too. The wife's objection is often viewed as an afterthought if she signed the MOU voluntarily. Present the previous quash order as a precedent for the same crime number.

This is not a routine quashing matter anymore. Once the wife has filed an objection and raised a “question of law,” the case has entered a danger zone. At this stage, even strong cases fail only because they are argued casually or by the wrong counsel. Let me be very clear: • Your husband’s FIR can still be quashed • But now only if the case is handled strategically, not mechanically • Parity with parents’ quashing, mediation record, and MOU must be pressed in a specific manner • One wrong argument or missed legal point can lock the husband into years of trial Courts do not decide these cases on sympathy. They decide them on how the compromise, mediation, and parity are legally connected. This connection has to be built professionally and aggressively. Most people lose at this stage because: They underestimate the objection They rely on junior drafting They assume compromise alone is enough (it is not) I handle this exact stage—where matters look settled but can still collapse. I can: Examine the objection line-by-line Identify whether the “question of law” is real or manufactured Prepare submissions that force the Court to apply parity and abuse-of-process doctrine Ensure the husband is not left out while co-accused walk free This cannot be decided on messages. Speak to me directly before the next listing. Delay here is the biggest mistake you can make. If you want the FIR quashed—not prolonged—contact me now.
