Hi my friend got caught with 50gm of coke on 22nd of august

Hi my friend got caught with 40of coke on 22nd of august he is behind the bars now what do you think how much time it will take to get the bail and what’s the right time to apply for bail.

Hi..your friends matter comes under Narcotics and therefore we have to be well prepared to apply for bail, taking our defences in best possible manner. It might take 1month for bail but cannot say. The right time to apply for bail is around 20th September that is almost one month of arrest. Till the time we can work on the bail application. You can approach me for further discussion.

I have gone through your query. The quantity mentioned by you is neither small quantity or commercial quantity. The criminal antecedent of the person involved will be considered. the offences under ndps act are non bailable in nature you will have to apply before special Court to prove the point that your friend has not committed The said offence do the quantity recoverd from your friend is not a commercial quantity yet the case will be decided on merits before the special Court

Well, what you are waiting out for? From your question, it can be ascertained, that, Your friend has been still languishing in Jail. He should have immediately applied for Bail. Now also, you can apply. From the concerned provisions of NDPS Act, I have to see, whether 40 gms of Coke is a commercial quantity or not! If it would not have been calling under commercial quantity, your friend will easily get the Bail.
