HelloMy phone was stolen in 2016 in Delhi. I launched an FIR. In 2017, I left Delhi and moved to KarnatakaIn 2019, I received a call from the PS that I am required to appear in court. I was outside India at the date and had moved out of Delhi and explained that I am unable to appearI again got a call from PS in Feb 23' that summon is issued for me to appear in court, but on that date, I will be out of India for work (Feb 23').Also, I am Canadian permanent residency moving to Canada in Mid-March 23. nnI have only received whatsapp messages. This new summon is also sent on whatsappThe caller said in that case I can write it and whatsapp but wasn't sure if it'll be accepted1. Can I make an Affidavit from another state in India and send it to Police Station?n2. Can I give a letter of authorization to a friend, relative in Delhi to appear and ask to close the matter?n3. In case I fail to appear and I move out of India, and do not return for years, what might be next action.

You can easily close the case by submitting your version in writing to the concerned court and if it is in anyway related to your lost mobile then also you can submit all relevant details and documents to show that you lost your mobile phone and had lodged complaint in this to the nearest police station in due time

Summons are being issued for recording your evidence into the matter. Would advise you to immediately consult a lawyer having experience in criminal law. Engage a lawyer in Delhi and file an appropriate exemption application seeking time from the court to appear. No your friend cannot appear on your behalf. You may contact
