Guidance on next steps after filing FIR, delay in chargesheet
04-May-2025 (In Criminal Law)
this is a case of physical fight between two persons. FIR has been done. Police said chargesheet has been created but not filed with the court. No court case has been done till now. Need guidance on what steps need to be taken next ? Who needs to file the court case police or the complainant ? what can be done to pressurize the police to file chargesheet in court? (there is video evidence available) How will the court case proceed without chargesheet? what are the legal ways to pressurize police
my dear friend this is subject matter of Investigation and before this I would like to suggest you kindly move a fair investigation application in concern code and after this you will definitely get the benefit it is only number of shoe where the investigation is pending more than more years so I would like to suggest to kindly move a petition or a movie application concern code for fair investigation when you file a fair instigation application in concern code then that code call the status report with reference to concerned FIR so for detail please contact me my number is 9140 5133 27 thank you
If chargesheet is not filed in court then you have 2 remedies. 1) you can file a Progress Report in the concerned Magistrate Court and request the court to call the case dairy of investigation
2) you can file a writ of mandamus in the Hon'ble High Court where Hon'ble High Court will direct the Police persons to file the chargesheet within 2 weeks or four weeks as court may deem fit
