Customs Authorities are duty bound to release the gold jewellery on payment of duty, if they are arbitrarily refusing to release the same which is contrary to provisions of Customs Act. Well, you have to file an Appeal before the concerned Customs Commissioner (Appeals) in order to recover your Gold under the concerned provisions of the Customs Act, 1962 and allied rules regulating such act and request the customs to provide you an opportunity to get your Gold back by allowing you to pay Redemption fine under Sec 125 of the Customs Act, 1862, Customs Duty, Penalty, 7.5% of Pre Deposit Amount to get your appeal admitted on board for Gold Recovery
