FIR U/S 398A - FILED ON ME (UNMARRIED GIRL) & MY MOM BY MY BHABHI
13-Nov-2023 (In Criminal Law)
An FIR u/s 498a has been registered against me (an unmarried sikh girl) and my mother (a senior citizen widow sikh lady) by my bhabhi. Though my bhabhi has has been living in her mayaka along with her husband (my brother) happily since nov. 2015. She is after our flat. My question is
a) What should we do to protect ourselves now?
b) We have been called by IO to join investigation, what we should give as our bayan?
c) How can my bhabhi file such case when she has not been living with us from Nov. 2015 and is happy with her husband? Cant court question validilty of such case?
d) Can we get a government lawyer ti fight our case?
Yes the question upon the credibility of an FIR can be raised. But for questioning the FIR you are required to lead the case in the court.
You can get the government lawyer (legal aid lawyer) but only when the trial began against you.
I would rather advice to quash the FIR on merits by the High Court.
