FIR quashing Process enquiry on a rape case, is it quashed without me

24-Jul-2025 (In Criminal Law)
Filed a rape case on a person who hid marital status and got into relationship with me.Promised marriage intially and later kept confusing. Have submitted clear proofs in chargesheet. Accused has filed a quashing petition and i am worried if the court will ask me to present or quash without my knowledge? Their strategy is to make the case appear consensual and divert courts focus away from deceit angle. What normally happens in such cases? is fir quashed easily and in how many hearings? Thanks

Once petition for quashing is filed before high court , a notice is issued to Respondent police station and informant (you). You will have to file your reply and thereafter argument will be done on all the aspects and there after petition will be decided by the high court.

With regards to bith if your questions... if a person approaches High Court to quash the FIR he has to first serve your lawyer (Public Prosecutor) a copy, intimate the Public Prosecutor the date the person going to court to file his petition for quashing the FIR, after that you'll submit your reply to his petition, arguments will happen, the court will hear both the sides and then come to conclusion whether to quash the FIR or not. And all this can be decided on first hearing itself if your PP is ready with reply and to argue the case. Else depending on your PP's strategy the hearings can take one or two dates..! So no without your say, or without hearing your side the HC cannot quash the FIR. Gather relevant documents, affidavits, and any other evidence that support your claim. Regards, Adv. Aakash Raghani

Well, it is not easy to get a FIR quashed in Rape Cases. As a Victim, you will be given a chance to get yourself represented by the State via Public Prosecutor who will put his best efforts to oppose Bail and Quashing for the accused legally.

Yes, in cases of rape based on deceit (like hiding marital status and false promise of marriage), courts take the matter seriously. If the accused has filed a quashing petition under Section 482 CrPC, the High Court may initially issue notice and seek a reply from you and the prosecution. The FIR is not quashed easily unless it is clearly frivolous or lacks evidence. Since you’ve submitted strong proof in the chargesheet, and if it shows the accused intentionally deceived you, the court will likely not quash the FIR without hearing your side. In most cases, quashing petitions take multiple hearings—typically 2 to 5. Courts also consider whether the consent for the sexual relationship was obtained by fraud or misrepresentation, which, as per law, vitiates consent and makes it a case under Section 376 IPC. The accused may try to show the relationship was consensual, but if your evidence clearly shows that consent was obtained by concealing marital status and false assurances of marriage, the court usually allows the trial to proceed. Stay in touch with your advocate, ensure your side is represented, and be ready to oppose the quashing petition strongly through written reply and oral arguments.

FIR of Rape offence cannot be quashed easily, unless the victim has given consent in writing to settle the same. Still, the presence of victim is generally required before the Court at the time of quashing the case. Also, it is not possible for the Accused to quash the FIR without hearing the Victim. However, make sure that you read the copy of the quashing petition and then request your advocate to file a reply to thd same. in case you require any further legal assistance you may contact me.
